    Convicted is: Spar Roofing & Metal Supplies Limited operating as Spar Marathon Roofing Supplies
    Date of conviction: November 18, 2019
    Location of offence: Calgary
    Date of offence: September 29, 2016
    Type: Serious Incident
    Description: A worker was securing a load on a trailer. The worker stepped onto a pallet that had been raised by a forklift. The pallet broke and the worker fell approximately 3.9 metres (m) to the ground. The worker suffered serious injuries.
    Conviction: Spar Roofing & Metal Supplies Limited pled guilty to Section 349(2) of the Occupational Health and Safety (OHS) Code, failure to ensure a work platform mounted on the forks of powered mobile equipment and intended to support a worker (a) was commercially manufactured or, if not commercially manufactured, was designed and certified by a professional engineer, (b) had guardrails and toe boards, and (c) had a screen or similar barrier that prevented a worker from touching any drive mechanism. They were fined $89,900 inclusive of the 15% Victim Fine Surcharge.
    All other charges were withdrawn.

    I love in Ontario Canada, and in January of 2023 while at work I sustained a left shoulder injury doing a job well above my pay grade. I am a left handed individual and I had previously made my intentions known that I was interested in moving into this position as soon as a position came available. I reported the injury on the day of the injury to my employer. it took nearly a week for the degree of the injury to become clear to me and subsequently I went to seek medical treatment. the physician that I saw suggested I take 2 weeks off of work in order to rest and repair any damage I had done to my shoulder. when this functional abilities form was submitted to the workplace safety and insurance board, I was told that they would not approve any type of loss of earnings for said 2 weeks, and I was forced to continue working for several months before being able to see a surgeon of the WSIB’s choosing. after seeing the surgeon and receiving instructions for an MRI to confirm any injury, I was able to take some time off of work in July and August. I saw the surgeon again in August after results from imaging came back. not showing any tears , the surgeon offered to perform a biceps tenodosis surgery which offered only a 50% chance of giving me any benefit. I opted to try the surgery due to the intense pain. surgery was scheduled for November 13th 2023. I did not see the surgeon again for 4 to 6 weeks post surgery. for those weeks I was confined to a sling and my dominant arm immobile. following my first checkup it was recommended that I start physiotherapy in the community. my first physiotherapy session was with a new hire at PT health Chatham physiotherapy, a lifemart company, who had not been trained on how to check somebody’s files for proper instruction and protocol for specific surgeries /procedures. The notes clearly state that the bicep should not be loaded. this physiotherapy assistant thought it a good idea to have me lift and transport up to 15 lb with a freshly reattached bicep muscle which caused excruciating pain for days afterwards. understanding that this person was new, I continued to go to treatment two more times the third time overall as I was doing a pendulum exercise which was used to reduce pain in the shoulder joint, placed 6 lb ball in my hand, which immediately gave me a sharp shooting pain from my hand to my shoulder, like a tearing. at this point I refrained from returning to community physiotherapy, and continued my exercises at home. The sharp shooting pain never completely left my left arm, my ring and Pinky fingers are both tingly and sometimes numb and the pain in my shoulder and elbow are worse than they were prior to surgery. in February 2024 I returned to work against my feelings and better judgment on the advice of the Ontario workers Network surgeon with restrictions in place. The manager of my place of employment refused to work with me in regards to my restrictions, continually expecting that I would do work outside of my restrictions even though I had been passed over four times for the position that came up that injured me in the first place. asking me to do things above my head asking me to do things like move an entire Bank of lockers and reach to the back of those lockers to make sure there’s no dust inside. I brought to my manager’s attention several times that these jobs were outside of my restrictions and I was told ” you’ll do whatever I tell you to do “. after being bullied at work for 3 months I decided I’d had enough and left my job. I was denied employment insurance, receive no money from the WSIB. and can no longer do the work I was doing prior to this. my last appointment with the OWN surgeon was a discharge from his care, without addressing any of my new pain, old pain, and nothing further from the wsib other than perhaps some money for the loss of function, which won’t be much according to my my claim manager. now what?
